Hire Information
Hiring Agreement
The hirer agrees that all charges for hire, loss, damage and repairs will be paid and all collection fees, legal fees, court costs or any expensed involved in the collection of these charges will be borne by the hirer.
Damage Agreement
The hirer shall be responsible for any loss of or damage to the equipment for any reason whatsoever except loss or damage which is caused by reasonable wear and tear. It is agreed that upon the completion of the period of hire whole or any part of the cost of replacement of the equipment must be met by the hirer.
Damage To Property Or Person
The hirer shall be responsible for any loss or damage to property or person caused by the equipment for any reason whatsoever during the period of hire and the hirer shall indemnify the owner in respect of all claims, damages and expensed in relation thereto.
Period Of Hire
The period of hire shall commence from the commencement date as shown overleaf or the time the equipment is delivered to the hirer whichever is the later and will cease when the said equipment is picked up by BOUNCING BAMBINOS staff.
Hiring Charges
Not withstanding anything herein contained hiring charges at the rates specified overleaf shall commence from the commencement of the period of hire and shall continue until the completion of the period of hire defined herein.
Breakdown
In the event of breakdown or failure of the equipment, the hirer shall under NO circumstances repair or attempt to repair the equipment without prior consent of the owner, in the event that such a breakdown or failure is caused by reasonable wear and tear and not by the hirer’s negligence or misuse or any other reason whatsoever than the period of hire shall be determined by the owner. In NO event shall the owner be responsible for any expenditure damages and or loss incurred by the hirer arising out of any breakdown or failure of the equipment whether caused by fair wear and tear, negligence on the part of the owner or any other reason whatsoever.
Termination By The Owner
The owner may not, notwithstanding the specified period of hire and notwithstanding any waiver or some previous default for with terminate this agreement and repossess the equipment in any of the following events:
- If the hirer shall fail to pay hiring charges upon delivery.
- If the hirer shall do or permit an act or anything whereby the owners rights in the equipment may be prejudice.
- If the hirer should become or made insolvent or bankrupt or made any arrangement or composition with his creditors or in the case of a hirer being a limited company should an order be made or a resolution passed for the winding up of such company.
- If the hirer commits any breach of the agreement for the purposes of repossessing the equipment, the owner may enter into or upon any premised where the equipment may be without prejudice to the rights of the owner to recover from the hirer any monies due here under or any damages for breach hereof and the hirer indemnities the owner in respect of any claims, damages or expensed arising out of any action taken under the clause. The agreement may not be transferred or assigned to any other party without the consent of the owner.
Rules and Conditions Of Hire
- THE CASTLE MUST BE SUPERVISED BY AN ADULT OVER 18 YEARS OF AGE AT ALL TIMES
- Ensure the children using the castle are of similar age and size
- NO shoes, eyeglasses or any sharp objects are allowed on the castle
- NO food, drinks or pets are allowed on the castle
- Somersaults, diving, wrestling, rough play and flips are prohibited
- In the event of rain evacuate the castle and turn the blower off
- In the event of high winds the castle may become unstable, again, castle should be evacuated and the blower turned off
- Absolutely NO streamers, party poppers or confetti are allowed on the castle
- The blower must not be turned on and off during the hire. This may cause overheating of the motor and result in motor failure or fire
- ADULTS ARE NOT COVERED BY OUR PUBLIC LIABILITY INSURANCE
- Absolutely NO fires or cigarettes near the castle at any time
